HPD Violations in NYC: How to Check, Correct and Clear Your Record

You fixed the leak, paid the contractor, and put the apartment back together. A few weeks later, the HPD violation is still open. What happened?

Repairs and record clearance are separate tasks. To resolve an HPD violation in NYC, you need to address the cited condition, follow the correct certification or dismissal procedure, and confirm the result in the building record. The right procedure depends on the violation, its age, and its current status.

This guide helps owners and property managers work out what to do next, without confusing HPD housing violations with DOB filings or OATH/ECB summonses.

How to look up HPD violations in NYC

Start with the official HPD Online building search. Search the address and review complaints, violations, registration, charges, litigation, and any vacate orders. A complaint and an issued violation are different records; check both.

Before calling a contractor, create a working list for each open item:

• Violation number and order number.
• Exact apartment, room, or common-area location.
• The condition described in the notice.
• Hazard class and current status.
• Correction deadline and certification deadline.
• Who will arrange access, perform the work, and prepare the paperwork.

Save the actual Notice of Violation with that list. Do not reduce a detailed notice to a label such as “bathroom repair.” A leak, damaged plaster, and mold may require different evidence even when they involve the same room.

HPD violation classes and correction deadlines

Class A means non-hazardous, Class B means hazardous, and Class C means immediately hazardous. The table below summarizes HPD’s published correction periods. Class C does not always mean 24 hours.

How to correct an HPD violation without losing track of the paperwork

1. Check registration early

HPD registration generally covers buildings with three or more residential units and one- or two-family homes where neither the owner nor the owner’s immediate family lives. Where registration is required, an invalid registration can block certification and a Dismissal Request. Check the record before repairs are finished, so this administrative issue does not become the next delay. See HPD’s registration requirements.

2. Define the repair and the evidence together

Ask the person preparing the repair scope two questions: “What has to be fixed?” and “What will we need to prove afterward?”

A useful job folder includes dated photographs, the location of the work, contractor information, a clear invoice, access correspondence, and any required permits, affidavits, testing results, or clearance reports. Photos and receipts support the file; they do not replace documents specifically required for that violation.

As a practical example, a ceiling stain may be the visible result of a plumbing problem upstairs. Painting the ceiling before investigating the moisture source can leave you paying for the same repair twice. Have the contractor explain both the underlying repair and the finish restoration.

3. Arrange access and verify completion

Give residents a clear description of the proposed work, the areas that need access, and the expected schedule. Keep a dated record of appointments and unsuccessful access attempts. If access remains disputed, get advice about the proper next step rather than assuming the deadline has stopped running.

Walk through the completed work against the actual notice. Check every cited location, not just the most visible repair. Ask for missing documents while the contractor is still involved.

4. Use the correct certification route

For eligible violations, HPD eCertification lets enrolled owners and managing agents certify correction online. Registration must be current, and enrollment is limited to eligible named parties. An HPD Online search is not itself a certification submission.

HPD’s Clear Violations guidance excludes lead, mold, and pest violations from eCertification and provides specialized instructions. Certify only completed work. HPD can audit a submission, and tenants can challenge it.

The repairs are done, but the violation is still open. What now?

First identify whether the problem is overdue certification, missing documents, or a condition HPD has not verified. Those situations should not all be handled the same way.

See HPD’s clearance options and its overdue-violation overview. Reissuance is limited: building history, litigation, repair charges, and the violation type can affect eligibility.

The June 2026 Dismissal Request form lists standard fees of $250 for private dwellings and individual condo/co-op apartments, and $300–$500 for multiple dwellings depending on violation count. Its inspection targets are 45 business days for June–September submissions and 90 business days for October–May submissions, using best efforts rather than guaranteed appointments.

Prepare access before requesting an inspection. Also follow the current form’s direction not to include lead, mold, or pest documentation with the initial application until requested. This differs from simply sending every document you have.

How much are HPD fines and violation-removal costs?

There are several separate costs: repairs, specialist testing, filing or inspection fees, professional coordination, and potential civil penalties. A contractor’s invoice is not the total compliance budget.

For violations issued on or after December 8, 2023, HPD publishes these examples:

*Special categories have different schedules. These are potential civil penalties, not an automatic invoice calculation. Issue date, category, building size, and enforcement circumstances matter. HPD identifies Housing Court as the forum for these civil penalties. Consult the official penalty schedule for special categories and older violations.

When requesting professional help, ask for a written scope separating record review, repair coordination, agency submissions, inspections, and legal work. That makes competing proposals easier to compare.

Conditions that need extra attention

Heat and hot water

Heat season runs October 1 through May 31. Between 6 a.m. and 10 p.m., apartments must be at least 68°F when it is below 55°F outside. Between 10 p.m. and 6 a.m., the minimum is 62°F regardless of outdoor temperature. Hot water must be supplied year-round at a minimum of 120°F. See HPD’s heat and hot-water rules.

Do not assume an owner has a standard waiting period after a heat complaint. Keep a service log showing the report, technician response, findings, and restoration of service.

Mold and pests

Local Law 55 addresses indoor allergens, including mold and pests. It is not a heat-monitoring law. Repairs need to address underlying moisture and entry points as applicable.

HPD states that buildings with 10 or more units must use independent New York State Department of Labor-licensed mold assessment and remediation professionals for mold areas exceeding 10 square feet. Class B and C mold violations in those buildings require supporting filing receipts. Read the indoor-allergen requirements before choosing a contractor.

Lead-based paint

Do not treat a lead violation as an ordinary repainting job. HPD distinguishes EPA-certified abatement firms from renovation firms; a renovation certification alone does not qualify a contractor to correct a lead-hazard violation.

The August 9, 2025 XRF testing deadline has passed for covered rental units and common areas. Check coverage and records under HPD’s paint-testing guidance. Testing is separate from hazard correction, annual investigations, and turnover work. Lead records generally must be retained for at least 10 years.

Owners should also review turnover and child-under-six requirements, including the July 1, 2027 deadline applicable to units where a child under six resided as of January 1, 2025. An earlier turnover can trigger the work sooner. That future deadline does not postpone correction of an existing hazard.

Buildings in the Alternative Enforcement Program

AEP is a separate enforcement program. Selection considers hazardous violations and emergency repair charges; discharge involves specific correction, payment, and registration requirements. Do not rely on a single violation-count shortcut or assume that clearing one notice ends participation. Follow the building’s notice and HPD’s AEP instructions.

When does an HPD violation also involve DOB?

An HPD condition may lead to repairs that need a separate DOB filing. Altered layouts, building systems, or other regulated work should be reviewed before the scope is finalized.

For example, an owner may discover that the condition cited relates to an earlier alteration. The first question becomes whether to restore the lawful condition or pursue an approvable legalization scope. That calls for a review of the records and existing conditions, not just a repair estimate.

HN REPUBLIC’s architectural plans and DOB filing coordination can help organize that side of the project with the appropriate design professionals. If a separate DOB violation or OATH/ECB summons exists, review our DOB and ECB violation resolution services. Keep a separate status line for each agency so one completed task does not hide another open item.

A practical owner’s checklist

• Read the full notice and identify both deadlines.
• Address urgent conditions immediately.
• Confirm registration and the correct responsible parties.
• Match the repair scope to every cited location.
• Identify specialist, testing, and permit needs before work starts.
• Keep access records and collect completion documents.
• Use the appropriate certification or dismissal route.
• Check the resulting HPD status and any separate agency records.

A useful tracking sheet has five separate columns: work completed, evidence complete, submission sent, agency response, and record status. Give each row a person responsible and a next-action date. This makes a building with multiple violations much easier to manage.

Frequently asked questions

Can I clear an HPD violation myself?

Eligible owners or managing agents can handle certification and applicable requests. Whether you also need a specialist depends on the condition and required work. Administrative submission does not replace a contractor qualification or professional filing requirement.

Does paying a fine remove the violation?

Do not treat payment as proof of clearance. Check whether the condition has been corrected and the applicable HPD process has been completed. Review monetary obligations separately.

Why is a repaired violation marked “Defect”?

It can mean HPD has confirmed physical correction but still needs required documentation. Review the specific defect letter before arranging another inspection.

What should I check before buying a building with open violations?

Ask for the notices, repair evidence, lead records, registration, and available charge and litigation information. Have your attorney and title team evaluate outstanding obligations and closing arrangements. Do not assume that a sale makes an open condition disappear or that every historic penalty automatically becomes the buyer’s personal liability.

Can a tenant stop paying rent because there is a violation?

A violation class alone is not a complete answer to a rent dispute. Tenants and owners should obtain case-specific legal advice about remedies, defenses, and court proceedings. Avoid making rent or lease decisions from a generic online fine chart.
