New Update on Parking Structures By DOB

Per the recent Department of Buildings Rule (1 RCNY §103-16), owners of parking structures within specific Community Districts must undergo a one-time initial observation of their facilities by August 1, 2024. This requirement is applicable to parking structures located in Community Districts 8 through 12 in Manhattan and all Community Districts across Brooklyn, Queens, Staten Island, and the Bronx. These districts fall under the purview of Article 323 of Title 28 of the NYC Administrative Code and 1 RCNY §103-13, necessitating periodic inspections by either December 31, 2025, or December 31, 2027.
Exemptions:
Community Districts 8 through 12 of Manhattan and Brooklyn Community Districts.
Parking structure owners within Manhattan Community Districts 8 through 12 and Brooklyn Community Districts who furnish a periodic inspection report by August 1, 2024, are exempt from undergoing an initial observation as mandated by the Department of Buildings.
Eligible People to Perform the Initial Inspection
The initial observation should be conducted by a New York State-licensed professional engineer, or under their direct supervision, who has been appointed by the Department of Buildings as a Qualified Parking Structure Inspector (QPSI). How to Submit the Parking Structure Initial Observation Report
Commencing in spring 2024, the initial observation report must be filed via DOB NOW: Safety no later than August 1, 2024. Before this period, a Service Notice will be issued, outlining the procedure for submitting the report through DOB NOW.
