In this post try to explain the SUSTAINABLE ROOF ZONE (LOCAL LAW 92/94)
In NYC, under Local Law 92/94 of 2019 Department of Buildings, started to force building owners and landlords to follow this regulation, as you can see on the DOB form (Sustainable Roof Zone )
For any Alteration type1 and New Buildings job you have 2 options to get approval for the submitted Layout,
You can do either a Green Roof or a Solar Panel.
But here is the important thing, you must pay attention to it before making any decision.
If you have a flat roof, you are able to choose one between these two options based on your budget and needs but if you have a pitched roof, just only one option for you to go with, and it’s Solar Panel.
Keep in your mind in some cases there are several factors to get exempt from solar panel systems or green roof
Such as the roof is exempt because the roof assembly has a slope greater than two units vertical in 12 units horizontal (17 percent)that would accommodate less than 4kw of solar photovoltaic electricity generating capacity.
for the plan examining part you have to submit a calculation of how much is the slope, how much available area you have to use for solar panels and a professional report to show can they generate the minimum amount of electricity or not
or a letter from HPD ( Housing Preservation and Development ) to say your building is not currently required to comply with this local laws 92 and 94
or for the LPC jobs (Landmark Preservation Commission ) before DOB approval, you need to get an approval letter from LPC and in some cases in order to keep the historic face of the building, they don’t let you do any Sustainable roof zone options.
For this exemption, you can submit the LPC documents with your layout to DOB.

In the end, I have to mention, that each job has different criteria different from the other jobs, and before taking any action, it’s better to spend more time, researching, and discussing your job with a knowledgeable and experienced architect.
